Terms of Service

1. Eligibility

You must be at least 18 years old to use Mallet. By using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into this agreement.

2. Important Health Disclaimers

2.1 Not Medical Advice

Mallet is a wellness and lifestyle application. It is NOT a medical device, does NOT provide medical advice, and is NOT intended to diagnose, treat, cure, or prevent any disease or health condition.

The information, recommendations, and insights provided by Mallet, including those generated by our AI assistant, are for general informational and educational purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment.

2.2 Consult Healthcare Professionals

Always seek the advice of your physician, registered dietitian, or other qualified health provider with any questions about medical conditions, new diet or exercise programs, supplement regimens, interpreting bloodwork, medication interactions, or any health-related decisions.

Never disregard professional medical advice or delay seeking it because of something from this app.

2.3 AI Limitations

Our AI features, including the Noot assistant, provide suggestions based on information you provide and general wellness principles. The AI cannot examine you physically, does not have your complete medical history, may make errors, and is not a replacement for qualified healthcare professionals.

2.4 Emergency Situations

If you think you may have a medical emergency, call your doctor, go to the nearest emergency room, or call 911 immediately. Mallet is not designed for emergencies.

2.5 Bloodwork, Supplements, and Medications

Our analysis of bloodwork is not diagnostic and should be discussed with your healthcare provider. Before starting, stopping, or changing any supplement or medication, consult a qualified healthcare professional.

2.6 Assumption of Risk

By using Mallet, you acknowledge that physical exercise, dietary changes, and supplements carry inherent risks. You assume full responsibility for any risks, injuries, or damages resulting from your use of the Service or reliance on information provided.

If you are a California resident, you expressly waive California Civil Code Section 1542, which provides: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release."

2.7 Glucose Monitoring

Glucose data, trends, and metabolic scores displayed in the Service are for informational and general wellness purposes only. They should not be used to make insulin dosing, medication, or other clinical decisions. If you use a continuous glucose monitor, always follow your healthcare provider's guidance for interpreting glucose data.

2.8 Peptides and Injections

The Service provides tracking tools for peptide administration, including reconstitution calculations and injection site rotation. These tools are for personal record-keeping only. Reconstitution calculations are estimates and should be verified independently. Always consult a qualified healthcare professional before starting, changing, or stopping any peptide or injectable protocol.

3. Account Registration

To use most features, you must create an account. You agree to provide accurate information, keep your password secure, and notify us immediately of unauthorized access. You are responsible for all activities under your account.

4. Subscription and Payments

4.1 Subscription Plans

Mallet offers subscription-based access to premium features. Details and pricing are displayed in the app at purchase.

4.2 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. For California residents: Your subscription will automatically renew and you will be charged the then-current rate unless you cancel before the renewal date, in accordance with Cal. Bus. & Prof. Code §17600 et seq.

4.3 Cancellation

Cancel anytime:

• iOS: Settings → [Your Name] → Subscriptions → Mallet → Cancel
• Android: Google Play Store → Menu → Subscriptions → Mallet → Cancel
• Web: Visit your Mallet account settings at mallet.so or contact support@mallet.so

Cancellation takes effect at the end of the current billing period.

4.4 Price Changes

We will notify you at least 15 days before any price changes take effect. Continued use after the price change constitutes acceptance of the new pricing.

4.5 Refunds

For subscriptions purchased via Apple App Store or Google Play Store, refunds are handled per their respective policies. Request refunds through Apple at reportaproblem.apple.com or through Google Play. For other billing inquiries, contact support@mallet.so.

4.6 Restore Purchases

Use "Restore Purchases" in app settings if you reinstall or switch devices.

5. Use of the Service

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.

You may not copy, modify, reverse engineer, or use the Service for commercial purposes without our consent.

6. User Content

You retain ownership of content you submit (meals, workouts, health data, etc.). By submitting, you grant us a limited license to use it for providing the Service.

You are responsible for the accuracy of your health information. Inaccurate data may result in inaccurate recommendations.

7. AI Features and Limitations

Mallet uses AI for personalized recommendations, meal analysis, and conversational assistance.

AI Technology, including the Noot assistant, uses generative AI that is known to produce inaccurate, incomplete, or fabricated information (sometimes called "hallucinations"). AI outputs are provided "as is" and should never be relied upon as the sole basis for health decisions.

AI may misinterpret inputs or provide suggestions unsuitable for your situation. Always verify important information and consult professionals for health decisions.

8. Intellectual Property

The Service, including design, features, content, software, and trademarks ("Mallet," "Noot"), is owned by us or our licensors and protected by intellectual property laws.

9. Privacy

Your privacy matters. Our collection and use of personal information is governed by our Privacy Policy.

10. Prohibited Conduct

You agree not to: use the Service illegally, harass others, submit false information, impersonate others, interfere with the Service, upload malicious code, access other users' data, or use the Service to compete with us.

11. Third-Party Services

The Service integrates with the following third-party services. Your use of these services is governed by their respective terms and privacy policies:

• Apple HealthKit and Google Health Connect (on-device health data)
• Oura, WHOOP, Garmin, Fitbit (cloud wearable sync)
• Dexcom (continuous glucose monitoring)
• Anthropic (Claude AI, AI-powered features)
• RevenueCat (subscription management & in-app purchases)
• Open Food Facts and USDA (nutrition databases)

We are not responsible for the content, practices, or availability of third-party services.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Service will improve your health or help you achieve any particular health outcome.

We are not responsible for loss of data due to service interruptions, device failures, or account inactivity.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

This includes loss of profits, data, personal injury, health consequences, or business opportunities, regardless of legal theory and even if advised of such possibility.

Our total liability shall not exceed the greater of the amount you paid us in the 12 months preceding the claim, or $100.

14. Indemnification

You agree to indemnify and hold harmless Mallet and its affiliates from claims arising from your use of the Service, violation of these Terms, or health-related decisions based on information from the Service.

15. Dispute Resolution

15.1 Informal Resolution

Before formal dispute, contact us at legal@mallet.so to attempt resolution.

15.2 Binding Arbitration

Disputes that cannot be resolved informally shall be resolved by binding arbitration under American Arbitration Association rules.

15.3 Class Action Waiver

YOU AGREE THAT DISPUTES WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS, NOT AS A CLASS ACTION.

15.4 Jury Trial Waiver

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND MALLET WAIVE ANY RIGHT TO A JURY TRIAL IN ANY ACTION, PROCEEDING, OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE.

15.5 Opt-Out

You may opt out of arbitration within 30 days of creating your account by emailing legal@mallet.so with "Arbitration Opt-Out" in the subject.

16. Termination

You may terminate your account anytime via Settings → Account → Delete Account or by contacting support.

We may suspend or terminate your account for violations. Upon termination, your access ceases and data may be deleted per our Privacy Policy.

17. General Provisions

• Governing Law: Delaware, United States
• Entire Agreement: These Terms and our Privacy Policy are the complete agreement
• Severability: Invalid provisions don't affect remaining terms
• Assignment: You cannot assign these Terms; we may assign ours
• Force Majeure: We're not liable for delays beyond our control
